The President and DOJ. Turning a blind eye to the law.
Over the last few weeks some things have happened that make me wonder exactly what Eric Holder and President Barack Obama believe. I will start with the Health care reform. It is well-known that 2 judges have ruled this act unconstitutional. The President and the DOJ like to cite that many more were thrown out. But why were they thrown out. Many were thrown out for lack of "Standing". In other words the court (Judges for the most part) ruled that the people who filed the complaint had no right to sue the government as they were not effected by the law. This might be the most ludicrous decision a judge could make (and partisan) as this law at its core effects everyone who is a United States citizen and possibly some who are not.
A few of the cases listed as upholding the law on the DOJ's web site were specifically about the Medicare or Medicaid provisions where unconstitutional. Even Judge Vinson in Florida ruled against the states on this matter. In his very detailed ruling he states that Medicaid being a voluntary program any burden placed by the federal government upon the states give them the choice to "opt out". Therefore all any case dismissed on this grounds is a wash in my eyes. Here is the statement of the DOJ on the Washington DC District court ruling.
“We welcome this ruling, which marks the third time a court has reviewed the Affordable Care Act on the merits and upheld it as constitutional. This court found – as two others have previously — that the minimum coverage provision of the statute was a reasonable measure for Congress to take in reforming our health care system. At the same time, trial courts in additional cases have dismissed numerous challenges to this law on jurisdictional and other grounds. The Department will continue to vigorously defend this law in ongoing litigation.”
Christians push back against gay agenda in Kansas
Recently there has been a push by liberals to advance the homosexual agenda into pivotal areas of American life. Barack Obama’s abolition of “don’t ask don’t tell” in the military has replaced silent service for gays with the requirement that the heterosexual majority of our fighting forces now accommodate a new, aggressive homosexual agenda if they wish to continue to defend the country. The foundation of traditional marriage in American culture is also under full assault. In another stunning attempt to force the homosexual agenda on the American people, Fox News reports that Barack Obama has ordered Attorney General Eric Holder to no longer defend the Defense of Marriage Act, the law of the land that states marriage as between a man and a woman, as constitutional. Thus we see the lengths liberals will go to achieve their goals, to fundamentally change society. What many might not be aware of is just how many parts of daily lives are being challenged by the gay agenda and the modus operandi of those involved.
If one looks closely, a repetitious pattern of presentation and action is observable from the liberal left. To start with, some radical change in traditional culture for the greater good is always forwarded, while at the same time the public at large is denied an opportunity to exercise their voices through a vote on the issue. When a people’s vote does slip by the liberal machine, it is later circumvented by a governmental fiat. To liberals, the best societal decisions are best made without society. The issue of how we recognize traditional marriage, the law that Barack Obama is now declaring void without the authority of the courts, as a tyrannical third-world dictator might do, is an issue that has already been decided by the voters. The overwhelming majority of Americans have already voted for traditional marriage as being between a man and a woman. Once again, it would take a complete subversion of the voting majority to attack this Judeo-Christian pillar of American society. Unfortunately, this is not just a Barack Obama problem. The actions of this President are simply a byproduct of a growing problem that has been taking place for some time in this country. Signs, Non lethal Ammo - Obama's way of Securing the Border
The Department of Homeland Security (DHS) reports that the nearly 2,000-mile U.S. border with Mexico is vulnerable to cross-border illegal activity.
Office of Border Patrol (Border Patrol), within DHS's U.S. Customs and Border Protection (CBP), is responsible for securing the border between U.S. ports of entry and has divided responsibility for southwest border miles among nine Border Patrol sectors.
CBP reported spending about $3 billion on Border Patrol's southwest border efforts in fiscal year 2010, apprehending over 445,000 illegal entries.
This testimony provides preliminary observations on (1) the extent to which DHS reported progress in achieving operational control--Border Patrol was able to detect, respond, and interdict cross-border illegal activity--of the southwest border; (2) the extent to which operational control reflects Border Patrol's ability to respond to illegal activity at the border or after entry into the United States; and (3) how DHS reports the transition to new border security measures will change oversight and resource requirements for securing the southwest border.
"We have devoted unprecedented amounts of manpower, infrastructure and technology to the Southwest border under this administration," DHS Secretary Janet Napolitano said. "Over the past two years, our seizures of illegal drugs, currency and weapons have increased significantly -- helping to make the Southwest border more secure than ever before."
So, which is it? The border is secured or the border is not secured as it ever was, Napolitano? GAO's preliminary analysis of the 873 border miles under operational control in 2010 showed that about 129 miles (15 percent) were classified as "controlled" and the remaining 85 percent were classified as "managed." Border Patrol stated that operational control does not require its agents to be able to detect and apprehend all illegal entries. read more »
